Reasons for divorce

You will be granted a divorce only if you can show that your marriage has suffered an 'irretrievable breakdown' because:

  • your husband or wife has committed adultery

  • their behaviour is such that you cannot be expected to live with them

  • they left you at least two years ago

  • you have been separated for two years and they agree to the divorce

  • you have been separated for five years or more

 

You should seek legal advice as soon as you can if:

  • you are at risk of having nowhere to live

  • you are at risk of domestic violence or abuse

  • your ex-partner is not giving you enough contact with your children

  • you are in a vulnerable financial position compared with your ex-partner

  • you are unsure what a fair settlement between you would look like

  • you have a lot of assets

  • you got married abroad, or you, your ex-partner or your children have non-UK nationality

 

 

Children

The welfare of any children involved in a divorce is placed before anything else by the law.

Our priority, if possible, will be to help you reach an agreement with your ex-partner for your children's sake. This might be about where the children live, how much contact they have with you both, how they will be provided for, and how decisions will be taken in future about things such as holidays and schools.

Mediation

Although you need a court order to get a divorce, you do not need to go to court to reach a divorce settlement with your ex-partner.

Mediation helps separating couples reach agreement even on the most difficult issues. Trained mediators do not take sides and will listen to you both.

Cohabitee disputes

Although these are either settled or litigated upon using the Civil rather than the Family Courts and rules, our expertise is again second to none.
